At the moment, Its the xbox that gets banned, Not the account (assuming you mean for using a modded xbox on live?) You shouldnt have any problems putting the HD on another xbox and carrying on. This may change though, who knows what M$ will do in the future, although banning the account would not be a good financial move by M$ whereas if the xbox is banned, they get revenue from the purchase of a new xbox and continued subscription to Live.
