All new xbox 360s have the lite-on drive. (wrong place to ask this)  I have been playing on LIVE for the first time ever for the pas couple of days.  I don't think they would ban a new customer until they made some money off of me and got me hooked on LIVE so I would buy a new xbox.  I'm not too worried though.  The new update came out today.

no, don't get confused, we refer to the Lite-on DVD-Drives that are included in most consoles nowadays that aren't hackable, the rest of the DVD-Drives (BenQ, Samsung, etc..) are hackable! remember the LITE-ON ones aren't!

Risk of being Banned: Yes, always a risk, because there is no SAFE modding method.  Also, if you play a game before the release date is a dead give-away.  They have to assume you downloaded it, and are playing it on a modded console, SO, they ban you.

Nothing is actually WRONG with the firmware; M$ just decides to initiate more tests on them once they get a hold of the hacked firmwares.  That is why the firmware version keeps increasing, because the HACKER fixes the item(s) that M$ is testing.  Don't think for one second that M$ doesn't find, and download these firmwares to run tests, to see where they are vulnerable.  How else would they KNOW what to test for?

They do many tests, and people that LIMIT the speed of their drives below 8x is a risk, because they can do a READ speed test.  If it were me?  I would position the laser on three equal spaced points of the disc; starting at the end, middle and beginning of the data track; and run a read test.  Each read will be different due to where the position is.  If say, they all read 4x, or 6x, then there is a problem, because the drives are 12x, and you should get at least a 10x optimal reading at the hub position (end of data on XBox consoles). 

There are many tests.  Some address the firmware directly for response times.  If they are too fast, then they know it is an automated response, and not a tested one.

Eventually, they will compare firmwares to what the console was shipped with, to what they see now.  They cannot do an on the fly checksum test, because every key is different, and it is IN the firmware code.  So, that means every checksum would be different.  So, THAT would mean, that the CRC would have to be stored in the console somewhere, and compared, if they do a checksum on the firmware code. That is another thing I would implement.   So the CRC, store, then check later dates.  Since you use hacked firmware, the CRC cannot and will not be what it was shipped with...
