In a landmark historic occasion today 11 June 2008 at the court of appeal criminal division the legal argument that modchips do not circumvent copyright protection was upheld by Judge Justice Jacobs.
The granting of this appeal based on the argument that the copyright infringement has already taken place before the use of a modchip has resulted in the squashing of all 26 counts against MrModchips
The defendant MrModchips was awarded full costs as a result of his successful appeal and offered his most sincerest thanks to his legal team and his many well wishers who had supported his fight for justice in the face of what are now no more than corporate public bullies.
The normally very vocal Michael Rawlinson from ELSPA was strangely unavailable for comment today.
Mr Rawlinson was originally quoted as saying: “It marks a milestone in the fight against piracy.”
What it does now is mark a milestone in the fight against overzealous independent agencies who have their strings pulled by corporations as opposed to the genuine concerns of the electorate.
What will these mean for modchips in the UK ?????? Truly a disaster for the likes of ELSPA and Trading Standards.









Ha ha! Yes! Thats great news! It is true though, modchips did not start piracy, look at the amiga, commodore and the nes, all had pirated games before a modchip was made, and a modchip in your console does not nescercarily mean pirated games, they are used for homebrew too, so clearly, it was the right choice for mr modchip to win!

If you have a PC, why do you need to run HomeBrew on a game console? People use modchips for the most popular reason, and that is for backups, aka Piracy.
Back in the Commodore days, you had to EDIT the game code to remove the error checking routines, resave to disc, so you could play the copy, so sure, modchips did not start it; however, today? They promote it more now, that they have been invented.
I can’t think of one person who has a MODCHIP just to play their own backups, stream media, or run “homebrew”; all without ONE illegal copy of a game? It’s just an avenue for illegal activities, always has been since the PS1 modchips were made.
The modchip should not be ILLEGAL though. If we buy the hardware, and I don’t care what a license says, we should own it, and be able to do with it whatever we please. The way we live today, we own nothing, really, we don’t. Owe someone money (especially a government), they can take your ownership away…

I have a modchip in my original xbox, why?
Not at all for illegal game copies, not a single one.
Simply for XBMC (much more than just streaming… internet browsing, recipes, and weather), Custom Halo Maps, and so I can watch DVD’s without the dongle.
I have friends who also have it for that reason, why?
We have every xbox game we played, so we didn’t need to copy/pirate games.
However, I’m not going to lie, if we didn’t have all of the games we wanted to play we would have pirated games.
As for my Xbox 360, I will not mod it until Homebrew comes out, I’m looking forward to what they can push this system too.
Same goes with my PSP, I never modded it until I saw IRshell…
Just get your points straight, not everyone is in it for the pirated game.
Only thing I have pirated something for is the PC.

This is very good news. It is crazy that we buy hardware and then are told we can’t do anything with it other than what we’re told by a corporation. Imagine the same thing happening if you bought a car.
Piracy would disappear overnight if the companies released games at a modest price. If Sony, MS or Nintendo sold their games for a 10th of the price they’d still make huge profits. Excessive greed is their motivation. Viva Mr Modchip. I’ve been a customer of his before and he has excellent service.
i am glad that the silly case has finally come to an end ,i for one am looking forward to the return of mr mod chip ,i have been a customer for some time now and if its was not for him selling parts and mod chips my psp would still be sat at home usable.
what the makers of consoles seem to forget is that once an individual has bought a console its then no longer the property of the console maker and as such the individuals are free to do what ever they like with/to them and this includes installing mod chips.
True. If I want to modify my PS3 or 360 to toast bread, who are the corporations to say I can’t?!! Try and stop me!!

Playing copied games is the least of the world’s worries. Many copied games I have played are dross, and I wouldn’t have bought them anyway!
If they stopped using region codes then they could easily make mods illegal. What does that tell us?
It tells us:
1. They make more money out of region coding games and videos than they do out of curbing piracy; and
2. They prefer to rip off the paying customers to cover the losses due to piracy, rather than cracking down on piracy as they ‘claim’ to be serious about!
Sony told a ‘half-truth’ about making the PS3 region-free; however they still region coded the console itself for both games and movies (both Blu-ray Disc and DVD). Only their ‘first-party’ games are region-free.
Well done Justice Jacob – he recognized region coding for what is is – extortion through market segmentation.

Region coding is stealing from consumers!
If I ran a store with a sign out the front saying ‘DVDs for sale, white people $40, Japanese people $50, black people $20′ I would rightly be charged with racism…
How is region coding any different?
Yeah, I don’t see why we have region coding. If they got rid of that, people would buy games and movies from all over the globe. Modchips help eliminate region restrictions, which allows the use of other region discs.
Still, more than 60% of people that do have modchips, will DOWNLOAD movies and games from other regions, they don’t buy them. This has been tracked with bittorrent sites, and why some were restricted from USA users.
In any case, I know why people use modchips, and why people ask me to help them, or install one. It’s not to stream, or run linux, it is so they can use emulators, RENT games, and put them on the HDD or copy it, plain and simple. Not one person has EVER asked me to mod, or help mod their console for any other reason except to pirate.
