I have had this happen to a few games, the last one being “Prey.” (also listed in the article). The disc was nicked up inside the case, but it still played.
If you’ve purchase a copy of the Halo 3 Limited Edition Tin then you may want to have a check inside before you take it home because there could be some very nasty scratches on the disc, according to several reports from Neogaf user (I do not know what retailer is going to let you open it on the spot to look).
The pictures that were released show some very deep scratches that appear to be fatal. It’s because the tin case has a plastic foam pad which is used to hold the disc into position, but it’s not doing the job correctly and the DVD’s are left crashing around the case which results in these harsh scratches.

One user reported that he had purchased 3 copies (already? Release date is 25th!) of the Limited Edition, and all copies contained loose discs that were scratched to death.
There was a similar problem with the Prey Collectors Edition, but this problem appears to be more fatal. We’ll try to get in contact with Microsoft to see if they’ve had any reports on this yet, if we find out anything then we’ll be sure to let you know here.

My brother just picked up the tin can version, so far so good, he’s playing it at his house now, to bad I don’t got one. He always checks the disks at the store though.
I got to beat Halo 3 yesterday! Wasn’t collector’s edition though. I’ve had my copy since Saturday…
Ya’ll gonna hate me for saying this but i gotta: Finally some bad news regarding Halo releases!!! A bunch of my friends (as well as me) believe Halo is the most over-rated series ever….BUT…I will admit, It does have great graphics, just not our type of game (plenty of FPS out there that are far more realistic violence which is what we want in FPS games)…
i just bought the limited pack today and both disc were scrash??can i sue microsoft for that??
You will have to take it back, this is a KNOWN problem, which is why I will open mine at the store, and see, IF I get the LTD edition.
just returned mine cuz of the same problem.
it took 3 copies in 1 day to get a set where the disks were good…..great job microsoft
I’m currently on hold w/ Microsoft…I’m one w/ a scratched disc as well…even the front of the metal case is scratched and they covered it up w/ black marker! Xbox’s website has a replacement program already in place for the limited edition Halo 3s and it looks like they want $23 Canadian to replace it! What a terrible track record they’ve had since the whole red rings of death incidents…

Microsoft has admitted there’s a problem with Halo 3’s Limited Edition packaging scratching game discs, and is now offering replacements via the Xbox website.
The problem is blamed on the plastic and foam nub in the LE tin designed to hold the discs; it turns out plenty of gamers - including CVG - are opening their copies of Halo to find the discs loose and scratched.
Dunno why you have to pay anything…
it was the disc replacement form they had a link to…I exchanged it at the store I bought it from without hassle…it’s just bad design on their part…especially for a flagship title like Halo 3…
…lol…in all fairness the guy on the phone was very apologetic and said just exchange it with the place you bought it from…but still…with all these mistakes they’ve made…Microsoft should stop playing baseball cause they seem to keep dropping the dam ball!
i just picked up my son’s copy for christmas and found out about this on the internet,so i opened it and sure enough the disc was severely scratched on the limited edition.

This happened to about 25 people that checked the disk before leaving the launch party I was at. Luckily my legendary edition was completely fine, as was the collectors edition of my friends.
If you buy at Gamestop/EB they will usually watch you open it to make sure it is not damaged.
